PART 1 — MEMBERSHIP TERMS & CONDITIONS

1. Declaration
I hereby declare that all information I provide on the application forms for new membership, and in applying for renewal of membership via the electronic data application, is true and correct.
I also agree to abide by the Perth Metro Sporting Clays Association Inc (PMSC) Constitution, Code of Conduct, and rules of Competition when applying to join or renew my membership.

2. Nature of the Club — Sporting Clays
PMSC is a sporting clays club. Membership requires that you hold, or are actively working toward obtaining, a current shotgun licence and any other applicable firearms licence required under Western Australian law. By applying for or renewing membership you confirm one of the following applies to you:

  • You currently hold a valid shotgun/firearms licence appropriate for participation in sporting clays activities; or
  • You are in the process of obtaining the required licence and are participating only in ways permitted under applicable firearms laws while your licence is pending.

All members and visitors agree to abide by all club rules and any applicable licensing requirements in force from time to time.

3. Club-Supported Firearms Licences
Where a member holds a firearms licence that is supported or sponsored by PMSC (a "Club-Supported Licence"), the following conditions apply:

  • The member must at all times remain compliant with the club’s requirements and all applicable Western Australian firearms laws.
  • Membership must be maintained as current and financial. Any lapse of membership — whether through non-renewal, voluntary cancellation, or termination by the club — will result in PMSC notifying the relevant licensing authority that the member no longer holds club support.
  • The member acknowledges that notification to the licensing authority may affect the status of their firearms licence and accepts full responsibility for any consequences arising from a lapse or termination of membership.
  • PMSC will provide reasonable written notice prior to initiating any action that may affect a member’s Club Supported Licence, except where immediate action is required for safety or legal compliance reasons.

4. Code of Conduct & Compliance
All members and visitors on PMSC grounds, or participating in any event conducted under the PMSC banner, must comply with:

  • The PMSC Constitution, Code of Conduct, and Competition Rules;
  • All applicable Western Australian and Commonwealth firearms laws, regulations, and licensing conditions;
  • Any lawful direction given by a PMSC range officer, committee member, or authorised official.

Failure to comply with the above requirements while on PMSC club grounds or while participating in any event conducted under the PMSC banner will result in an investigation by the PMSC management committee. Depending on the outcome of that investigation, penalties may include a formal warning, suspension, or termination of membership. Where the non-compliance involves a potential breach of firearms law, PMSC reserves the right to report the matter to the relevant authority.

 5. Membership Fees
Existing Members Renewing Membership: Renewal fees, once paid, are not refundable. Membership fees paid are not transferable to any other person or member.

New Members — Application Fee:
A one-off, non-refundable registration fee applies to all new membership applications. This registration fee will not be refunded under any circumstances, including where the application is refused by PMSC or where the applicant withdraws their application.

In the event that a new membership application is refused, the annual membership fee component of any payment made (i.e. excluding the non-refundable registration fee) will be returned to the applicant’s nominated bank account within 21 days. No membership card will be issued in such circumstances.

Where an applicant voluntarily withdraws their application before it is determined, the annual membership fee component may be refunded at the discretion of the PMSC management committee. The registration fee is not refundable in any case.

6. Assumption of Risk
You understand the inherent risks associated with firearms and related activities. Such activities have a degree of risk and cannot be made completely safe. By participating in these activities and competitions, you freely, knowingly, and voluntarily assume all risks associated with this activity.

7. Liability Release — Covenant Not to Sue
You agree that when you become a member and make use of the facilities and services provided by PMSC, you do so at your sole risk. You also agree that PMSC is not responsible for the actions of any of its members or guests during the period of your membership.

If you bring any personal property onto the premises, parking areas, or grounds of PMSC, you do so at your own risk. PMSC is not responsible in any way for damage to, or loss of, any personal property you bring onto their premises, including but not limited to losses due to theft, damage, or motor vehicle accident.

You agree to hold PMSC, its successors, assigns, owners, officers, managers, employees and agents harmless from all claims which may be brought against them by you or on your behalf, by your family, or by your executors, administrators, and personal representatives for any such injuries or claims. You hereby forever release and discharge PMSC, its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses, and expenses.

This release applies even where damages, injuries, or fatalities result from events not directly related to the events contemplated by this agreement. This section will survive any cancellation, expiration, or termination of this agreement.

8. Legal Counsel
By proceeding to payment for membership you declare and accept that you have read and understood these conditions as an agreement between yourself and PMSC. You acknowledge that you have been given the opportunity to consult with legal counsel before accepting this agreement and that you agree to these terms either with legal counsel’s approval, or having waived your right to legal counsel and accepted the risk of this agreement without the benefit of counsel.

PART 2 — COMPETITION ENTRY TERMS & CONDITIONS

9. Eligibility
To enter any PMSC Competition you agree that all persons being entered by you are recognised financial members of PMSC as defined by the rules of the Association, with current membership fees paid.

10. Competition Entry for Minors (Juniors)
PMSC is unable to provide or accept responsibility for the supervision of minors at competitions or events. Any minor not holding a recognised firearms permit that allows them to own or use a firearm and ammunition outside of supervision must be accompanied at all times by their parent or an authorised guardian arranged by the parent.

It is the responsibility of the parent or guardian to accept full responsibility for, and supervision of, the minor at all times while the minor is in possession of a firearm or ammunition, and at all other times whilst on club grounds or property.

11. Competition Entry Payment
All entry fees for a selected competition must be paid in full before you are recognised as having a reserved place. Once entry fees have been paid, any cancellation of your entry will incur a $10.00 administration fee. The remaining balance of the entry fee will be reimbursed to your nominated bank account.

12. Cancellation of Competition Entry
To receive a refund of your paid entry fee (less the $10.00 administration fee), a written request to cancel must be received by PMSC a minimum of 14 days before the start of the competition. Any reimbursement request received after this period will be at the discretion of the PMSC management committee. Entry fees are not transferable to another member.

13. Competition Cancellation by PMSC
PMSC reserves the right to alter, amend, or cancel all or any competitions registered at any time. Where a competition is cancelled by PMSC, the entry fee will be refunded in full with no administration fees levied. Refunds will be processed within 21 days of the cancellation notice by the same payment method used for the original payment.

PMSC will not be held responsible for compensation for any personal loss, including but not limited to travel reservations, flights, or accommodation booked in preparation for a cancelled event.

14. Assumption of Risk — Competition
You understand the inherent risks associated with firearms and related activities at competition events. By participating, you freely, knowingly, and voluntarily assume all risks associated with this activity.

15. Liability Release — Competition
You agree that your use of PMSC premises and facilities during a competition event is at your sole risk. PMSC is not responsible for the actions of any of its members or guests present at the competition event. Personal property brought onto PMSC premises, parking areas, or competition grounds is brought at your own risk. PMSC is not responsible for damage to, or loss of, personal property, including but not limited to losses due to theft, damage, or motor vehicle accident.

You agree to hold PMSC, its successors, assigns, owners, officers, managers, employees, and agents harmless from all claims arising from your participation. You hereby forever release and discharge PMSC from all claims, demands, injuries, damages, actions, losses, and expenses. This section will survive any cancellation, expiration, or termination of this agreement.

16. Image Rights
You consent to photographs, videos, and electronic images being taken of you before, during, or after a competition. You acknowledge and agree that PMSC owns those photographs, videos, and images and may use them, along with your name and voice, for promotional purposes through any medium without further consent. PMSC is not responsible for photographs, videos, or electronic images taken during the competition that have not been solicited by PMSC.

17. Force Majeure
PMSC cannot accept liability or pay compensation where the performance of its obligations is prevented or affected by circumstances beyond its reasonable control (“force majeure”). Force majeure events include, but are not limited to: war or threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, pandemic, or government-imposed restriction or direction. By proceeding to payment for competition entry you accept these conditions.

18. Privacy
PMSC uses Pin Payments to process payments. This is a secure payment gateway and no financial details are stored by PMSC. PMSC does not store credit card details and does not share customer details with any third party other than as required by law or as necessary to process your payment.

PART 3 — GENERAL

19. Amendments to Terms & Conditions
PMSC reserves the right to revise these Terms & Conditions at any time without prior notice. The current version will be published on the PMSC website at www.pmsc.club. Continuing your membership with PMSC after any revision constitutes your acceptance of the revised Terms & Conditions. Members are encouraged to review the Terms & Conditions periodically.

20. Governing Law
These Terms & Conditions are governed by the laws of Western Australia. Any dispute arising from or related to these Terms & Conditions or your membership with PMSC shall be subject to the exclusive jurisdiction of the courts of Western Australia.

21. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
